Intellectual Property Policy

Bazatify respects the intellectual property rights of others and expects our users to do the same. This policy outlines our approach to addressing allegations of infringement of copyright, trademarks, design rights, and other intellectual property rights in accordance with the laws of the United Kingdom.

Please contact Bazatify’s Legal Department via e-mail at [email protected] (the preferred method of contact) for any and all notices and counter-notices of claims of intellectual property infringement.

Bazatify reserves the right to terminate the accounts of users who are found to be repeat infringers of intellectual property rights in appropriate circumstances.

A. Reporting Infringements

If you believe that your intellectual property rights have been infringed by content on Bazatify.co.uk, please provide Bazatify’s Legal Department at [email protected] with the following information in writing (the “Notice”):

1. Your full legal name and contact information (address, telephone number, and email address).
2. A clear and specific description of the intellectual property that you claim has been infringed (e.g., details of the copyrighted work, trademark, or registered design). If you believe multiple works have been infringed, please provide a list with specific descriptions of each.
3. Precise details of where the allegedly infringing material is located on Bazatify.co.uk, including URL(s) or other identifying information that will allow us to locate the material.
4. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the intellectual property owner, its agent, or the law.
5. A statement that the information in your notice is accurate and that you are the intellectual property owner or authorised to act on behalf of the owner.
6. Your physical or electronic signature.

Upon receipt of a valid infringement notification, Bazatify will take appropriate action, which may include removing or disabling access to the allegedly infringing material. We will make reasonable efforts to notify the user who posted the material of the removal or disabling of access and may provide them with a copy of your notice and your contact information.

Please note that if you fail to provide all of the required information in your notice, it may not be considered valid, and Bazatify may not be able to take action.

Making false or misleading claims of intellectual property infringement may have legal consequences.

B. Responding to Infringements (Counter-Notice)

If you believe that material you posted on Bazatify.co.uk has been removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice to Bazatify’s Legal Department at [email protected] with the following information in writing (the “Counter-Notice”):

1. Your full legal name and contact information (address, telephone number, and email address).
2. Identification of the material that has been removed or to which access has been disabled and the exact location (URL or other identifying information) where the material appeared before it was removed or disabled.
3. A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. A statement that you consent to the jurisdiction of the courts of England and Wales and that you will accept service of process from the person who provided the original notification of infringement or an agent of such person.
5. Your physical or electronic signature.

Upon receipt of a valid counter-notice, Bazatify may forward it to the party who submitted the original infringement notification. The removed material may be reinstated or access re-enabled, typically within 10-14 business days after receipt of the counter-notice, unless the original complaining party notifies Bazatify that they have filed a court action seeking a court order to restrain the allegedly infringing activity.
